Appeal by plaintiff from Lyon, J., at November Term, 1921, of Pasilico. Civil action to recover on a life insurance policy issued by tbe defendant to Reginald Paul, now deceased, tbe plaintiff being named as beneficiary in said contract of insurance.

On 3 July, 1919, tbe defendant entered into a contract of' insurance witb plaintiff’s minor son, a boy fifteen years of age, whereby it was agreed tbat tbe Reliance Life Insurance Company of Pittsburg, Pa., would pay to tbe plaintiff, mother of tbe insured, tbe sum of $5,000-upon receipt, at its borne office in Pittsburgh, of due proof of tbe death, of Reginald Paul; provided, said contract of insurance was in full force and effect at tbe time of bis death.
