Plaintiff and 16 other contractors submitted to the defendant school board bids for the erection of a school building. As evidence of good faith' and a guaranty that the successful bidder would enter into the contemplated contract, furnish bond, etc., each was required to deposit along with his bid five per cent, of the amount thereof. Plaintiff delivered to defendant in connection with his bid a cashier’s check for $5,100. The day the bids were opened, February 28, 1927, Mr. Edwin E.
