In a probate proceeding, the proponent appeals from so much of an order of the Surrogate’s Court, Richmond County (Fusco, S.), dated December 30, 2002, as denied those branches of the proponent’s motion which were for summary judgment dismissing the objections based on fraud and undue influence.

Ordered that the order is modified, on the law, by deleting the provision thereof denying that branch of the proponent’s motion which was for summary judgment dismissing the objection based on fraud and substituting therefor a provision granting that branch of the motion; as so modified, the order is…
