CHIN, District Judge.

In this case, plaintiff Times Mirror Magazines, Inc. (“Times Mirror”) asserts claims against defendants Field & Stream Licenses Company (“FSLC”) and Jerome Y. Lavin for breach of contract and trademark infringement arising out of the parties’ longstanding concurrent uses of the “Field & Stream” trademark. Both parties, or their predecessors, have been using the Field & Stream mark for nearly a century.
