OPINION

AMDAHL, Chief Justice.

We granted the state’s petition for review of the decision of the Court of Appeals holding that the trial court erred in denying defendant’s 1985 petition for relief, in the form of a new trial, from two 1983 convictions of assault with a dangerous weapon, Minn.Stat. § 609.222 (1984). The Court of Appeals ruled that defendant’s trial counsel failed to represent him effectively, that defendant was prejudiced as a result, and that therefore a new trial was required. Gates v.
