HARPER, Senior District Judge.

Appellant was tried before a jury and was found guilty of violating the conspiracy statute, 18 U.S.C. § 371 (Count I), and of aiding and abetting in making a destructive device, in violation of 26 U.S.C. § 5861(f) and 5871 (Counts II and III). He was sentenced to five years imprisonment on Count I, and five years each on Counts II and III, to run concurrently with each other, but consecutively with Count I. Appellant was also ordered to make restitution and assessed a special assessment of $50.00 per count. These convictions arose out of the occurrences of two…
