Pending before this Court is a motion to compel arbitration brought by Defendant AT & T Mobility LLC f/k/a Cingular Wireless LLC (“Defendant” or “ATTM”) (Docket Entry # 75). Plaintiff Barry Hall (“Plaintiff’ or “Hall”), as class representative, has filed opposition as well as a motion to strike the declaration of Richard Nagareda that was filed in support of Defendant’s motion to compel arbitration.
