DELEHANT, District Judge.

The plaintiff, a corporation organized under the laws of Missouri, filed its complaint in this action on August 17, 1948 under its then corporate name of Schreiber Milling and Grain Company, against the defendant, a Nebraska corporation. The matter in controversy exceeds in value the sum of $3,000. Whether it be premised upon the infringement of a technical Trade-Mark in violation of statute, Title 15, U.S.C.A. § 1121, or upon diversity of citizenship, Title 28 U.S.C.A. § 1332(a) (1), jurisdiction unquestionably exists.
