United States v. John Blank
Court of Appeals for the Sixth Circuit
1Opinion of the Court
EDWARDS, Circuit Judge.
In this ease the government appeals from an order entered by a District Judge in the United States District Court for the Northern District of Ohio granting defendant’s motion for suppression of evidence in an organized gambling case. The evidence, which was seized under an admittedly valid search warrant, represents work sheets of a sports and horse book betting business. The sole issue presented is whether or not the fact that these records may be in the handwriting of the defendant requires the granting of defendant’s motion to suppress on Fifth Amendment grounds.
