Robert A. Tallent v. United States

Court of Appeals for the Fifth Circuit

Decided October 11, 1979No. 78-3406PublishedCited by 3 opinions

1Per curiam

The appellant, Robert R. Tallent, filed a pro se petition under 28 U.S.C. § 2255, seeking to have his conviction and sentence for armed bank robbery under 18 U.S.C. § 2113(d) vacated. His petition challenges the validity of the proceeding in which he entered a guilty plea and alleges that in determining his sentence the district court relied in part on a prior unconstitutional conviction. The district court denied Tal-lent’s petition without a hearing, holding that the grounds for relief which' it stated had been the basis of a prior application by Tallent for collateral relief. We affirm.
