delivered the opinion of the court:.The question raised in this case involves the constitutionality of section 36 of an act entitled “An act in regard to evidence and depositions in civil cases,” approved March 29, 1872, as said section was amended in 1919. (Laws of 1919; p. 710.)

The relator, Harold L. Ickes, was on July 17, 1919, appointed by the Supreme Court of the Province of Ontario, Dominion of Canada, to take the depositions of witnesses on oral examination in the city of Chicago in a suit pending in said court.
