LOKEN, Circuit Judge.

Norman Bernard Weaver pleaded guilty to conspiracy to commit bank fraud in violation of 18 U.S.C. §§. 1344 and 1349. The district court 1 overruled Weaver’s objection to a two-level enhancement under U.S.S.G. § 2Bl.l(b)(ll)(C)(i), resulting in an advisory guidelines sentencing range of 33 to" 41 months in prison. The court varied upward and sentenced Weaver to 96 months, expressly stating that “no matter how these guidelines would have come out, I still get to the same place under the 18 U.S.C. 3553(a) factors.” Weaver appeals his sentence, arguing the district court…
