In its second amended complaint, the plaintiff, Brooks Pond Conservation Association, Inc. (“BPCA”), as the possessor of property under a lease with BPW, Inc. (“BPW”), seeks a declaration of its rights to said property. The property in issue is a large tract of land and a body of water now known as Brooks Pond, situated in Spencer, North Brookfield, New Braintree, and Oakham, Massachusetts.
