This appeal is from a judgment of the district court of Oklahoma county, rendered upon a verdict convicting the defendant of the crime of wife and child abandonment, but the jury failed to agree upon the punishment. On March 6, 1937, motion for new trial was denied. Thereupon the court sentenced the defendant to be confined in the state penitentiary at McAlester for the term of seven years.
