Plaintiff in error, W. C. Cowley, was convicted in the district court of Oklahoma county, on a charge of child abandonment, and was sentenced to confinement in the state penitentiary at McAlester for a term of ten years.

From the judgment he appealed by filing in this court on February 5, 1937, a petition in error with a duly certified transcript of the record attached, labeled, “Case-made.”

It appears from the record that the preliminary information was filed before Leo B. White, justice of peace, Oklahoma City justice district, April 17, 1936, charging: “that on the 17th day of April, 1936,…
