POWELL, Presiding Judge.

The plaintiff in error hereinafter referred to as defendant, was charged by information filed in the county court of Kay County with the crime of omitting to provide for a minor child. He was tried before a jury on the 2nd day of April, 1953, found guilty, but the jury being unable to agree upon the penalty to be assessed, left that to the court, who entered judgment ordering that defendant be confined in the county jail for a period of one year, and pay a fine of $200 and costs of the action; but providing, “Said confinement and payment of fine to be suspended upon…
