The Government appeals the district court’s award of attorneys’ fees to Maritime Management, Inc. pursuant to the Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412.

I. FACTS AND PROCEDURAL HISTORY

In September of 1994, the Department of the Navy through Military Sealift Command solicited bids for a contract to supply layberthing facilities and services for two SL-7 Fast Sealift Ships.
