The testimony was all written or printed; *307and upon this state of facts and the authority of Martin vs. Brown, 4 Minn., 282, it is insisted that this Court should examine the testimony for the purpose of determining its weight. The views expressed in favor of the propriety of this course in Ma/rtin vs. Brown, were not, so far as we can discover, necessary to the decision of that case.
