Gilbert Dutcher, lessee and sole ostensible proprietor of the Metropolitan Hotel, in St. Paul, died on October 1, 1873. Soon after his death, one of his sons-in law, Edwin E. Gilbert Dutcher, lessee and sole ostensible proprietor of the Metropolitan Hotel, in St. Paul, died on October 1, 1873. Soon after his death, one of his sons-in law, Edwin E. The proceedings before us on this appeal originated in the probate court of Bamsey county, and the matters involved were tried and determined in the district court, upon an appeal taken from the decree of a probate court. Bespondent, having been removed from her position as administratrix of the estate of her deceased husband, Gilbert Butcher, presented her final administration' account, for settlement and- allowance by the probate court.
