Appeal by the defendant, The N ational Park Bank of Hew Y orle, from an order of the Supreme Court, made at the Hew York Special Term and entered in the office of the clerk of the county of Hew York on the 28th day of June, 1907;, granting a peremptory writ of mandamus commanding the defendant to permit the relator to- have undisturbed inspection of the stock book of the defendant.

Ingraham, J.:
The relator in his petition makes this application under the provisions of section 29 of the Stock Corporation Law (Laws of 1890, chap. 564,* as amd. by Laws of 1901, chap. 354). That section provides that “ Every stock corporation shall keep at its office * * * a book to be known as the stock-book, containing the names, alpha.betically arranged, of all persons who,are stockholders of the corporation, showing their places of residence, the number of shares of stock held by them respectively, the time when they respectively became the owners thereof, and the amount paid thereon.…
