The plaintiff in error sues here to recover upon a contractor’s bond executed by Hansel and Rouch as contractors with their codefendants as sureties, for material sold, delivered by it to them, and used by the contractors in the building of a school in the city of Sapulpa. This bond is in the usual and statutory form ■as provided by section 3881, Revised Laws 1910, except it is made payable to the board of education of said city instead of to the state of Oklahoma.
