Abdul Ali Rabie (“Abdul”) was indicted for armed robbery and theft by receiving stolen property. In 2004, a jury found him guilty of armed robbery, but not guilty of theft by receiving stolen property. The trial court sentenced Abdul to 20 years with 12 to serve. Pursuant to a granted out-of-time appeal, Abdul challenges the trial court’s amended order denying his motion for new trial, contending that the trial court erred in denying his motions for mistrial and severance, and in admitting a witness’s out-of-court identification of him.
