MEMORANDUM

TENNEY, District Judge.

Plaintiff Salwen Paper Company, Inc., Profit Sharing Retirement Trust (“Sal-*132wen”) has moved herein for an order pursuant to Rule 15 of the Federal Rules of Civil Procedure (“Rules”) permitting plaintiff to serve an amended complaint in this action in the form annexed to its moving papers (Exh. A). Since, as will appear hereinafter, this motion is addressed to the Court’s discretion, an overview of the prior history of this litigation may prove helpful.
