Summary
This matter comes before the court on cross motions for partial summary judgment. [Dkt. Nos. 48 and 53].
The plaintiff, Anderson, seeks a ruling as a matter of law that defendant Wells Fargo Home Mortgage Company did not properly disclose to her the ‘Wield Spread Premium” (“YSP”) paid to it by her Lender, Long Beach Mortgage, for brokering a loan at a higher interest rate than was otherwise available. She claims such a disclosure was not made at all, and that even the disclosure Wells Fargo claims to have made was insufficient…
