Appeal from a judgment of the County Court of Otsego County (Coccoma, J.), rendered February 23, 2004, convicting defendant upon his plea of guilty of the crime of assault in the second degree.

Defendant was charged in an indictment with assault in the second degree after he attacked another man with a screwdriver. He pleaded guilty to this charge and waived his right to appeal. Under the terms of the plea agreement, County Court agreed to sentence defendant to no more than five years in prison, to be followed by a three-year period of postrelease supervision.
