1 Reported in 265 N.W. 39. Action by brother against brother to recover for personal injuries resulting from an automobile collision. Plaintiff had a verdict. Defendant appeals from the order denying his alternative motion for judgment notwithstanding or a new trial.

The accident occurred about 3:30 p. m. December 29, 1933. Defendant was driving his Plymouth coupé westerly on a paved highway 20 feet in width with nine-foot shoulders.
