KENNERLY, District Judge.

February 14, 1935, before the discovery and production (on June 13, 1935) of petroleum oil and gas in the city of South Houston, in Harris county, in this district and division, the mayor and city commissioners or aldermen of the city, purporting to act under the laws of Texas (title 28 of the Texas Revised Civil Statutes 1925 and Amendments [Vernon’s Ann. Civ. St. Tex. art. 961 et seq.]), regulating cities and towns and villages, passed and adopted an ordinance, extensively regulating the search for, drilling for, production, etc., of oil and gas within the city.…
