This is an action of trespass on the case for malicious prosecution. The trial in the Superior Court resulted in a verdict for the plaintiff for seven hundred dollars. The case is before us on the defendant’s exceptions as follows: to the refusal of the trial justice to direct a verdict for the defendant and to the ruling of said justice denying the defendant’s motion for a new trial.
The plaintiff occupied a basement apartment in an apartment house owned by the defendant. For a short period the plaintiff was employed as a janitor by the defendant at said apartment house. The defendant…
