The United States charged defendant Olatunji Abayomi with possession of heroin with intent to distribute it and with conspiracy to possess the same in violation of 21 U.S.C. §§ 841(a)(1) & 846 (1982). After a four-day jury trial the jury found Abayomi guilty on the conspiracy charge, but not guilty on the possession charge. Abayomi moved for a new trial and for a judgment of acquittal.
