On September 8, 1980 the plaintiff, Arthur Wigand, obtained the entry of a judgment in the United States District Court for the Southern District of New York against the debtor for damages awarded after a nonjury trial on one count alleging common law fraud and deceit as well as misstatements in the sale of securities, and one count of breach of contract.
