This is an appeal from an amended judgment entered on December 17, 1992 in the United States District Court for the Southern District of New'York, Edelstein, J. The district court granted Olin Corp.’s (Olin) motion for partial summary judgment, denied Consolidated Aluminum. Corp.’s (Conaleo) motion for partial summary judgment and dismissed with prejudice'Conalco’s first claim for relief in its counterclaim which was based on the Comprehensive Environmental Response, Compensation, and Liability Act' of 1980, 42 U.S.C. § 9601 et seq.
