Plaintiff in error, who was plaintiff below, brought an action against defendant to recover damages and there was verdict and judgment in favor of the latter. The litigation came on in this way: Nolan-Smith & Co., a Minnesota corporation, had a contract with St. Paul Union Stockyards Company, a corporation, by which Nolan-Smith obtained permission to establish and conduct the business of buying and selling live stock at and upon the premises of the Stockyards Company at South St. Paul, Minn.
