On November 15, 1983, an amended information was filed in the Los Angeles County Superior Court charging defendant Charles E. McDowell, Jr., with murder, attempted murder, attempted rape and burglary. (See Pen. Code, §§ 187, 261, 459, 664; all further statutory references are to this code unless otherwise indicated.) The information alleged that defendant personally used a knife in the commission of the murder. (§ 12022, subd. (b).)
