This matter is before the Court on two identical motions to dismiss under Rule 12(b)(6). The first motion was filed by Defendant Nancy Mayer (“Mayer”), in her official capacity as Chairperson and Treasurer of the Retirement Board of the Rhode Island Employees’ Retirement System (“Retirement Board”).
