ORDER
MOORE, District Judge.
Defendant United States of America (hereinafter “the United States”) has, in this admiralty action, filed a Motion to Dismiss on the grounds that this Court lacks jurisdiction over the United States due to insufficient process under 46 U.S.C. app. § 742. Fed. R.CivP. 12(b)(1). Additionally, Defendant has moved to dismiss Plaintiffs claims against Defendant American Foreign Shipping (hereinafter “AFS”) on the grounds that it is barred by the exclusivity clause of 46 U.S.C. app. § 745.
