GARTH, Circuit Judge:

William G. O’Connell, III appeals from the district court’s order dismissing his complaint for lack of subject matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1). The primary issue on appeal, which is one of first impression in this circuit, is whether O’Connell’s punitive-damage claim 1 premised on an arbitrary and willful failure to pay maintenance and cure is barred by the exclusivity provision of the Suits in Admiralty Act (“SAA”), 46 U.S.C.App. § 745.
