The defendant below, Johnie Howard, was charged, tried, convicted of the crime of second degree manslaughter, and sentenced to 90 days in jail and to pay a fine of $500.

The information upon which this conviction was predicated, in substance, alleged that the defendant, on September 23, 1945, in Kiowa county, Okla., did wrongfully, feloniously and with culpable negligence, so drive, his 1934 Buick sedan automobile at a speed greater than would permit him to stop within the assured clear distance ahead having due regard to the traffic, surface and width of the highway and the condition of said…
