This is an action arising from the alleged violation of various rights secured to plaintiff, Update Art, Inc., under both federal and state law in connection with plaintiff’s publication of a print entitled “... AND I LOVE NEW YORK” (hereinafter sometimes referred to as the “artwork”). The work at issue is a colorful panoramic cartoon portraying a bustling, fictional New York City street corner.
