WILBUR, Circuit Judge.

On January 13, 1931, appellee sustained personal injuries when struck by an automobile truck owned and operated by appellant Robert Hind, Limited. On January 26, 1931, in consideration of the sum of $84.50, appellee signed a release, releasing and discharging appellant “from all claims, demands, damages, actions or causes of action, on account of injuries resulting, or to result,” from the accident. Thereafter, on January 10, 1933, appellee filed a bill in the Circuit Court of the First Judicial Circuit, Territory of Hawaii, for cancellation of the release, alleging that…
