MEMORANDUM

JOHNSON, Chief Judge.

In this suit eight interstate rail carriers contend that the State of Alabama is discriminating against interstate commerce by assessing rail transportation property at a value that has a higher ratio to the true market value than the ratio that other commercial property bears to its true market value. They allege that this action violates the Commerce Clause and the Supremacy Clause of the United States Constitution, the Equal Protection Clause and the Due Process Clause of the Fourteenth Amendment to the United States Constitution, and the Railroad…
