Appeal from a judgment of the County Court of Albany County (Herrick, J.), rendered August 25, 2014, convicting defendant upon his plea of guilty of the crimes of scheme to defraud in the first degree, identity theft in the second degree and criminal possession of a forged instrument in the second degree.

Pursuant to a negotiated plea agreement, defendant waived indictment and pleaded guilty to scheme to defraud in the first degree, identity theft in the second degree and criminal posses sion of a forged instrument in the second degree as charged in separate superior court informations.…
