This case is before the Court on remand from the Supreme Court pursuant to the following order:

On order of the Court, the delayed application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we vacate the judgment of the Court of Appeals and remand the case to the Court of Appeals, which shall consider and decide Issue n in the plaintiffs Court of Appeals brief.
