Appeal from Circuit Court, Jefferson County; C. B. Smith, Judge. Action by 6. K. Letson against the Mutual Loan Society, to recover money alleged to have been paid by the plaintiff to the defendant on subscription for stock in the corporation. Judgment for plaintiff, and defendant appeals. Transferred from Court of Appeals under section 6, p. 449, Acts 1911.

This case was previously here on review of the action of the trial court in granting a motion for a new trial. Mutual Loan Society v. Letson, 200 Ala. 251, 76 South. 17.
[1] It now appears from the undisputed evidence in the present record, differing from the case as presented on former appeal, that the plaintiff (Letson) had paid for the capital stock to an agent of the defendant (appellant) ; that he received and still held the duly signed certificate for the number of shares he purchased; that he had received two dividends on the stock; and that the stock books of the company…
