In 18 U.S.C. § 1962(c), the Racketeer Influenced and Corrupt Organizations Act (“RICO”) makes it “unlawful for any person employed by or associated with any enterprise engaged in ... interstate ... commerce, to conduct or participate, directly or indirectly, in the conduct of such enterprise’s affairs through a pattern of racketeering activity.” In this case, the issue is: Does a union merely by conducting a recognition strike against an employer “conduct or participate, directly or indirectly, in the conduct of” the employer’s affairs within the meaning of section…
