THIS CAUSE comes before the Court on Defendants’ motion for taxation of costs as the prevailing party [DE 45]. I have reviewed the record and am advised in the premises.
On April 3, 2009, this Court issued an Order [DE 42] granting Defendant’s motion to dismiss for lack of jurisdiction, dismissing both federal claims with prejudice, and dismissing the state law claims without prejudice.
