OPINION

BRETT, Judge:

Appellant, Darrell Tipton, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Oklahoma County,^ Case No. CRF-73-318, with the crime of Unlawful Distribution of a Controlled Dangerous Substance, specifically Heroin, in violation of 63 O.S.1971, § 2-401. He was sentenced to serve a term of ten (10) years in the State penitentiary in accordance with the verdict of the jury and a timely appeal has been perfected to this Court.
