Augustus Kinsey was convicted of violating the Alabama Uniform Controlled Substances Act and sentenced to 20 years' imprisonment under the Alabama Habitual Felony Offender Act. That conviction was affirmed on direct appeal without opinion.Kinsey v. State, 511 So.2d 276 (Ala.Cr.App. 1987). In 1987, Kinsey filed a petition for post-conviction relief alleging the ineffective assistance of trial and appellate counsel.
