In his petition for rehearing, which we construe as a petition for panel rehearing, the appellant, Donald Lowry, argues that the Supreme Court’s decision in Firestone Tire & Rubber Co. v. Bruch, — U.S. -, 109 S.Ct. 948, 103 L.Ed.2d 80 (1989), mandates a rehearing in this case. Bruch holds that courts should apply a de novo standard of review in ERISA actions under 29 U.S.C. § 1132(a)(1)(B) (1982) unless the terms of the trust instrument re quire deference to plan administrators.
