The plaintiffs are the father and mother of Rosalino Ortolano, a boy five years of age, who, they alleged, was killed while crossing the -railroad track of the defendant corporation at its intersection with the public road about 300 feet below the bridge leading to and crossing Harvey’s Canal. They prayed for judgment for $45,000 damages against the defendant, alleging that their said child died of injuries received on Easter Sunday, April 7, 1901, by being run down and struck by an engine (with a caboose attached) of the defendant about 4:30 p. m.; that…
