LAVENDER, Justice:
The present case deals strictly with the propriety of the trial court’s rulings regarding the custody of the minor daughter of the parties in this divorce action. The first appeal in this ease challenges the portion of the divorce decree entered by the trial court in which custody was granted to appellee mother. The second appeal is from the trial court’s denial of appellant’s motion for new trial based on newly discovered evidence allegedly affecting the propriety of the grant of custody. Both appeals have been consolidated for consideration.
